Approach
When I first became a lawyer and practiced commericial litigation with a large Philadelphia law firm in the early 1990's, I often wondered, how did people get to a place where they were willing to spend thousands of dollars on attorneys fees and court hearings over a dispute that could have, and should have, been resolved long before. The answer I found was that one, or more, of the parties had stopped listening, and one, or more, of the other parties felt they were no longer being heard. Mediation and Collaborative Practice make sense to me because people listen, people are heard, and that enables acceptable solutions for those that want to try.
