Description of Practice

This Mediator is Certified
Collaborative mediation truly involves all parties taking part in the process. This benefits those involved in a divorce by giving both parties the opportunity to speak openly and honestly with a Mediator who is impartial, and willing to listen and facilitate their making an agreement. Jim Kuykendall is that type of Mediator/Facilitator. Jim will help the parties communicate with each other and reach a mutual settlement that they design for themselves. This type of collaborative mediation gives the parties an alternative to litigation that involves one party going against the other in a win/lose situation. The parties involved reach a mutual agreement rather than the court making the decision. If both parties are willing to work through the issues Jim can help.

  • I believe in the Facilitative approach to mediation.
  • Meeting with parties individually or in joint sessions.

  • Confidentiality is the basis for the trust that is put in me.
  • I believe there really are two (maybe more) sides to every issue.
  • All parties involved should be able to speak and be understood.
  • I am a facilitator – not a judge. I don’t give opinions or advice.
  • I ask questions and assist the parties looking for options.
  • I move the conversation toward a resolution designed by the parties.
