Description of Practice

Gerszon Associates' primary mission is to transform intractable, dysfunctional conflict productively. We help people settle disputes; organizations negotiate professional, business, and environmental conflicts; as an alternative to litigation savings of both time and money can be achieved. Our knowledge-based multipartial approach engages the principle of multipartiality as distinct from neutrality. Neutrality often makes us accomplices to the dispute whereas giving each side a hearing provides a foundation on which the disputants can build a lasting agreement to move forward.

The knowledge base so acquired frames the skills and expertise I employ in serving to resolve disputes, in both profit and not-for-profit sectors. I have an intimate familiarity with stakeholders of all stripes; line staff, senior management, boards of directors.

Degrees

I read Economics (Systems Theory) and Genetics (Epidemiology) at the University of Alberta, Edmonton, Alberta, Canada and have held various designations including Canadian and United States Securities licenses (CIM, Series 7 and 63). I trained at the University of Washington Law School Mediation Training Workshop and certified as a mediator through the Pierce County Center for Dispute Resolution (PCCDR) in Washington State.

Approach

Facilitative, Evaluative, Settlement/negotiation: Our approach to mediation engages the principle of multipartiality as distinct from neutrality. Neutrality often makes us accomplices to the dispute whereas giving each side a hearing provides a foundation on which disputants can build a lasting agreement to move forward. We engage the parties to tell their own stories and views in such a way as to enable these perspectives to be understood by everyone involved in the mediation process. Instead of creating an atmosphere of disengaged neutrality, we endeavor to get the various truths out there for all to witness and appreciate. Without this transparency, it is not possible for the parties to work together, to collaboratively address the problems and arrive at solutions that are mutually agreed-to and enforceable.

Fees

Mediation and Arbitration fees are based on an hourly basis, with a minimum retained commitement of 4 hours. Per diem rates are assessed through an evaluation of the nature of the challenge. Intervention Consulting fees reflect the nature and extent of the project and will be estimated on a project by project basis. Our Multipartial Approach to Intervention Consulting provides management and other stakeholders consulting specialties in business/organization turnaround. Management consultancies typically adopt a lengthy process of analysis, interviews and reporting which can take months to deliver remedial plans. What is really needed is immediate triage on the broken elements of the business; a rapid short-term containment and tangible, visible results moving the remedy and recovery process along. Intervention Consulting does what its name implies: it intervenes; immediately at board and operating levels, and applies rapid and pragmatic fixes which affect the company's product/service delivery and the behavior of an often embattled staff. Time is of the essence! Other resources are also at risk. Personnel, market presence, contract deliverables are challenged; possibly the life of the organization and with it the futures of all stakeholders, workers included. Hence our rapid engagement with the broken elements and dysfunctional relations is targeted at effecting a triage. Not simply to stop the hemorrhage but also to implement a range of pragmatic fixes for immediate impact. In short, to sort out the mess!
